1. Introduction

PassionClass is dedicated to protecting our users and their personal information. PassionClass as an entity is hereafter referred to as “we,” “our,” and “us” in this document. This Privacy Policy details the collection, use, and security of personal information obtained from users through our platform or any services we provide, hereafter referred to collectively as “Services,” in this document. By using our website, or any of our Services, users are consenting to the terms of agreement in this Privacy Policy. The entity PassionClass is a Controller, which is a legal term that means, in summary, that we are responsible for determining how and why to collect these data points.

2. What Information is Required

For Course Participants

It is necessary to collect personal information from users to fulfill our services to users including at minimum first and last name and email address. These are necessary so that we can confirm that you are the person who has the right to be in the course and send you a link to the online course (via a video conferencing system, which may change), and inform you of any issues (such as teacher absence due to illness, for example). It is unlikely, but it may be necessary during the fulfillment of our services or other legal obligations to contact users to request or provide more information.

Collected Personal Information:

1. First name, last name, and email address. This is for the purpose of confirming your seat in the course (as your right to a seat in a Course is non-transferable), as well as contacting you with any necessary information about the course, such as providing you with the video conferencing link (which may change after you purchase a seat in the course) or informing you of necessary changes (for example, a class is canceled. The legal basis of collecting this information is its necessity to complete the contract. It is also for the purpose of being able to verify course participation if you should request for us to do so in the future. Thus, at the present time, we plan to hold this information for 10 years, though we may shorten this duration in the future. We will also have to share this information with your Course Provider so that he or she can verify your seat in the Course during Course sessions. To opt out of the ability to request that we verify your participation in a Course in the future and have us remove your personal information, you can email us any time after the completion of your course at [email protected].

For Course Providers

1. Email address. This is for the purpose of being able to contact about bookings in your Course and your services as a Course Provider. The legal basis of collecting this information is its necessity to complete the contract.
2. First name, last name, and address. We are legally obligated to collect this information to fulfill legal obligations, such as reporting payments to tax agencies. We will hold this information as long as you have a relationship as a Course Provider with us. If you close your account as a Course Provider, or are inactive as a Course Provider for 3 years, then we will remove this information after our legal obligations are fulfilled.
3. Payment information, such as an bank account or IBAN number: We may collect this information because we need it in order to fulfill our contractual obligation with you, i.e., in order to pay you.
4. Face photo, video introduction, and course description text: the basis of the collection of this data is that it is necessary to fulfill the contract between us and display your course properly on the PassionClass website. Because we wish to have a high quality website that gives end users the ability to make an informed choice about whether they wish to purchase a seat in a Course, providing basic information about the instructor is not optional. Please do not sign up to be a Course Provider if you are not willing to provide this information. The purpose is to be able to display it on your Course page (and further advertising, with your consent) and help Course Participants to find you and increase the likelihood they enroll in your Course.

For all of the information you provide as a Course Provider, if you contact us at [email protected] to end your relationship with us as Course Provider, or are inactive as a Course Provider for 5 years, then we will remove this information after our legal obligations are fulfilled.

3. Data Collection and Storage

Data is collected from users who voluntarily share personal information with PassionClass during the registration process, and additional information may be requested. This data is necessary for PassionClass to provide its services, and by voluntarily supplying this data, users are consenting to allow PassionClass to view, collect, store, and otherwise use this information. Personal information is stored for the duration of services between PassionClass and the user. Please see Section 3 for more information.

4. Payment Information

Payment for our Services are processed through an independent, third party payment processor, PayPal. PassionClass does not directly process or store users' payment information. For more details on how personal information is used in payment processing, refer to PayPal’s Privacy Policy.

5. Who can see my information?

Users' information may be shared with third parties when deemed necessary while assisting PassionClass with our operation. Payment information will be processed by our payment processor, PayPal. Payment information will never be shared with other platform users, course participants, or course providers.

Course participants' names and email addresses may be shared with their Course Provider. Course providers will receive the names and email addresses of all participants registered to their course. When you book a seat in a Course, you are entering into a contract directly with the Course Provider. In order to fulfill the contract, the Course Provider may have to contact you.

A course provider's name, email address, profile photo(s), introduction/biography, class video, or any other media or information provided by the provider may be on display to any and all PassionClass platform users. Payment information will never be shared with other platform users.

User information may be disclosed to the authorities, or any necessary organization, to fulfill obligations as required by law, and only to the extent as required by law.

6. Security

PassionClass is dedicated to maintaining and securing all user information against unauthorized seizure, alteration, disclosure, deletion, or otherwise unwanted access to personal information. Safety measures are put in place to protect and secure user data. The protocols for a data breach are as follows:

1. Investigate the breach and identify which information was or may have been compromised
2. Notify the appropriate authorities/organizations, and notify all users which have or may have been affected
3. Secure the breach and prevent and further compromise or damage
4. Keep all parties involved well-informed about the ongoing breach and what measures are being taken to amend it
5. Discover how a breach occurred, identify vulnerabilities, and make improvements to prevent data compromise in the future

7. Live Classes, Camera & Microphone, and Recording

Live classes take place in real-time video rooms provided by our video partner, Daily.co. When you join a live class, your device's camera and microphone are used to send and receive audio and video so that you and others can take part. You remain in control of your camera and microphone and can mute or turn them off at any time during the class.

Recording. A class host (the teacher) may choose to record a class. Not every class is recorded — recording is at the host's discretion. Whenever a class is being recorded, you will be informed: you will see a recording notice or indicator before or as you join. If you do not wish to be recorded, you may choose not to join, or keep your camera and microphone off and refrain from speaking. By remaining in a class after being notified that it is being recorded, you consent to that recording.

At the host's request, PassionClass may download a recording of their class and provide it back to that host for their own teaching records. Recordings may be stored temporarily by our video partner and by PassionClass in order to deliver them to the host. Access is limited to the host and to PassionClass staff who help deliver recordings and provide support. 8. AI Features (LearnFlow)

Some features — including LearnFlow, our self-paced course builder — use artificial intelligence provided by a third party (OpenAI) to help teachers generate course outlines, lessons, and quizzes. When a teacher uses these features, the prompts and text they submit are sent to that AI provider so it can generate the requested content. Please do not enter personal, sensitive, or confidential information into AI prompts.

9. Analytics & Third-Party Service Providers

We use Mixpanel to understand how people use PassionClass — for example, which pages and features are used — so that we can improve the product. This involves the usage and device information described above.

To operate PassionClass we rely on the following third-party service providers, who process data only to provide their service to us:

1. Daily.co — live video classes and recording.
2. OpenAI — AI-assisted course generation (LearnFlow).
3. Mixpanel — product-usage analytics.
4. DigitalOcean Spaces — storage of uploaded images and files.
5. PayPal — payment processing (see the Payment section above).

These providers may process data in countries other than your own. We share only the information each provider needs to perform its function.

10. Content You Upload

When you upload images — such as a profile or teacher photo, or a class cover image — those files are stored with our storage provider (DigitalOcean Spaces) and may be displayed publicly on the platform, for example on class listings and teacher profile pages. Please upload only images you have the right to use, and avoid including other people's personal information. You can update or remove your images from your account, or by contacting us.

11. Your Rights

Users have the following rights:

1. To access their own personal information, including names, email address, address, photos/videos, and any other personal information or media belonging to a user
2. To edit personal information to maintain accurate and current data
3. To request the removal and deletion of their own personal information from the PassionClass platform pending the termination of any contractual obligations (i.e., the completion of a running Course)
4. To request a copy of the data you have sent us (please reach out to [email protected])

12. Privacy Policy Updates

PassionClass reserves the right to update this Privacy Policy at any time. Changes to the Privacy Policy are effective immediately after public posting to the PassionClass platform. Use of the PassionClass platform and/or services after a Privacy Policy update is considered consent to the Privacy Policy. The newest version of the Privacy Policy supersedes any previous Privacy Policy.

13. Marketing Email List

PassionClass reserves the right to update this Privacy Policy at any time. Changes to the Privacy Policy are effective immediately after public posting to the PassionClass platform. Use of the PassionClass platform and/or services after a Privacy Policy update is considered consent to the Privacy Policy. The newest version of the Privacy Policy supersedes any previous Privacy Policy.
